This article discusses listening that is appropriate to sound art and the associated changes in the paradigms, or thought patterns, that occur so often when we move from visual to aural perception. The distinction between historically accepted and rejected sounds is used to show how putting sounds in cages has fashioned a form of listening and of life. Twentieth-century experimental music and, especially, the music and the reflections of John Cage have opened these cages of sound and at the same (...) time weakened the visual paradigm for intellectual knowledge. This article examines sound art as a place where artistic practices coincide with certain theoretical issues centered on sound. The centrality of sound is approached first, and music and sound art are discussed in relation to space. Second, the attention to sound in the reception of prominent examples of sound art focuses on site-specific relationships with the city and with listening. The article concludes by affirming the need for an aesthetic reflection that takes into consideration the implications of these profound transformations. Cognitive symptoms after COVID-19 have been increasingly recognized several months after the acute infection and have been designated as “brain fog.” We report a patient with cognitive symptoms that started immediately after COVID-19, in which cerebrospinal fluid biomarkers were highly suggestive of Alzheimer’s disease. Our case highlights the need to examine patients with cognitive symptoms following COVID-19 comprehensively. A detailed assessment combining clinical, cognitive, and biomarker studies may help disentangle the underlying mechanisms associated with cognitive dysfunction in each case. El ajuste entre Estado y nación en Latinoamérica ha observado complicaciones desde la fundación de sus repúblicas. La pluralidad de subjetividades, realidades materiales y brechas, sumadas a las coyunturales demandas insatisfechas y una débil institucionalidad influyeron en que las construcciones nacionales hayan tenido un componente populista en diferentes intentos refundadores. En los países andinos ese componente se expresa a partir de unas condiciones sociopolíticas previas a las performativas identidades nacionales y la presencia de liderazgos personalistas. Parte de los estudios sobre (...) identidades nacionales en estos países se centraron en el análisis de sus liderazgos y discursos. Otros optaron por centrarse en los procesos o condiciones de posibilidad que favorecen la irrupción de estas identidades. El objetivo del trabajo es brindar una base epistemológica que emerja de la compatibilidad entre los anteriores abordajes explicativos de las identidades nacionales. (shrink)

ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof. En este trabajo utilizamos em método de mapeo sistemático para la recopilación, análisis y extracción de información en publicaciones que indican el uso de Shiny para explicar conceptos estadísticos. Zusammenfassung Der Beitrag analysiert auf der Basis theoretischer Überlegungen sowie empirischer Ergebnisse Möglichkeiten und Grenzen einer „interkulturellen Öffnung“ von Sportvereinen, worunter Strukturanpassungen verstanden werden, die auf die Inklusion und Integration von Personen mit Migrationshintergrund zielen. Es wird gezeigt, inwiefern eine nachhaltige interkulturelle Öffnung der Vereine von der programmatischen Anbindung an den Vereinszweck, von der kontinuierlichen Behandlung in den Kommunikationswegen, von spezifischen Personalentscheidungen und der Kompatibilität mit der Organisationskultur abhängig ist.

As part of the social distancing measures for preventing the spread of COVID-19, many university courses were moved online. There is an assumption that online teaching limits opportunities for fostering interpersonal relationships and students’ satisfaction of the basic need for relatedness – reflected by experiencing meaningful interpersonal connections and belonging – which are considered important prerequisites for student motivation and vitality. In educational settings, an important factor affecting students’ relatedness satisfaction is the teachers’ behavior. Although research suggests that relatedness satisfaction (...) may be impaired in online education settings, to date no study has assessed how university lecturers’ relatedness support might be associated with student relatedness satisfaction and therefore, student motivation and vitality. This study tested this mediating relationship using data collected during the early days of the COVID-19 pandemic. The study also investigated whether the relations were moderated by a high affiliation motive which reflects a dispositional wish for positive and warm relationships. The possible importance of the communication channel selected by the lecturers and the format of a class were also investigated. In a sample of N = 337 students, we tested our hypotheses using structural equation model. Results confirmed mediation, but not moderation. The use of video chat seems to facilitate the provision of relatedness support but our data did not show that the format of a class was associated with relatedness. Our findings indicate that both teaching behavior and the technical format used to deliver lectures play important roles in student experiences with online classes. The results are discussed in light of other research conducted during the pandemic. (shrink)

Zusammenfassung Der Beitrag verfolgt das Ziel, Mechanismen der Inklusion und Exklusion in Sportvereinen zu identifizieren, die die Partizipation von Personen mit Migrationshintergrund am organisierten Sport erklären können. Im Lichte von theoretischen Überlegungen zur „symbolischen Grenzziehung“ und „Zugehörigkeit“ werden Ergebnisse aus Fallstudien in Nordrhein-Westfalen und Baden-Württemberg präsentiert.

Zusammenfassung Der Beitrag untersucht den Gebrauch von Moral in der Kommunikation zwischen Trainer und Ath­leten im Spitzensport. Dabei wird moralische Kommunikation aus systemtheoretischer Perspektive als soziale Tatsache konstruiert, um im Lichte dieser Konstruktion konkrete Beispiele aus den Sport­arten Handball und Hockey analysieren und im Hinblick auf ihre Funktionen und Folgen reflektie­ren zu können. Die Ergebnisse dieser Analysen münden in Empfehlungen an Trainer, die zu einem sensiblen Umgang mit Moral raten, da insbesondere dem polemogenen Charakter moralischer und moralisierender Kommunikation Rechnung zu (...) tragen ist. Zusammenfassung Die Vereinbarkeit von Spitzensport- und Schulkarriere gestaltet sich für schulpflichtige Nachwuchsathleten sehr schwierig. Der vorliegende Beitrag konstruiert diese Unvereinbarkeit zunächst als Inklusionsproblem und beschreibt dann prinzipielle Lösungsmöglichkeiten im Rahmen einer Funktionalisierung von Schulen. Dabei wird insbesondere die sachliche Funktionalisierung in Form der strukturellen Kopplung von Spitzensport und Schule in den Blick genommen. Am Beispiel der „NRW-Sportschulen" und der „Spezialschulen Sport" in Brandenburg werden schließlich Möglichkeiten und Grenzen dieser strukturellen Kopplung diskutiert und Barrieren der sachlichen Funktionalisierung von Schulen identifiziert.

Zusammenfassung Spitzensport zu betreiben und gleichzeitig ein Hochschulstudium zu absolvieren, scheint unter den derzeitigen Umständen nahezu unmöglich. Der Artikel konstruiert dieses Phänomen der Unvereinbarkeit zweier Karrieren zunächst gesellschaftstheoretisch als Inklusionsproblem. Da eine merkliche Verbesserung der Situation der Athleten letztlich nur auf Seiten der Hochschule erwartet werden darf, werden anschließend aus organisationstheoretischer Perspektive die dortigen Möglichkeiten und Grenzen interner Strukturveränderungen reflektiert. Schließlich wird diskutiert, wie Hochschulen mit den Erwartungen des Spitzensports umgehen können und in welcher Weise sich im Rahmen von Netzwerken (...) womöglich doch Kooperationsbeziehungen zwischen den beteiligten Organisationen zugunsten studierender Spitzensportler aufbauen lassen. Zusammenfassung Der Beitrag analysiert auf der Basis theoretischer Überlegungen sowie empirischer Ergebnisse Möglichkeiten und Grenzen der Steuerung interkultureller Öffnung von Sportvereinen durch Sportverbände. Es wird gezeigt, dass die interkulturelle Öffnung der Vereine funktional ausgerichteter Strategien seitens der Sportverbände bedarf, die an die Ziele und Zwecke der Vereine anschließen, und dass Netzwerke den zentralen Mechanismus bei der Koordination der Interorganisationsbeziehungen zwischen Sportverbänden und Sportvereinen darstellen.

Zusammenfassung Dem deutschen Fußball scheint es geradezu mühelos zu gelingen, Spielerinnen und Spieler mit Migrationshintergrund zu integrieren, was sich deutlich in der Zahl betreffender Spielerinnen und Spieler in den Auswahlmannschaften des Deutschen Fußball Bundes zeigt. Die Mannschaften des Deutschen Handball Bundes dagegen rekrutieren sich bislang ausschließlich aus rein deutschstämmigen Spielerinnen und Spielern. Beim Handballsport scheint es sich hierzulande bislang um etwas ausgesprochen „Deutsches“ zu handeln, mithin um eine Sportart, die fast 20 % der Bevölkerung kaum erreicht und dabei offenkundig sogar (...) die größte Migrantengruppe, nämlich diejenige mit muslimischem Hintergrund, so gut wie vollständig ausschließt. Der Aufsatz steckt sich das Ziel, all jene Mechanismen der Exklusion von Migranten im Handball zu identifizieren und in einem theoretischen Modell zusammenzufassen, die in Deutschland zur Unter- bzw. Nichtrepräsentanz von Spielerinnen und Spielern mit unterschiedlichem Migrationshintergrund im Handballsport beitragen. Aufbauend darauf werden Leitfragen für eine empirische Untersuchung der Exklusionsmechanismen abgeleitet. (shrink)

El consentimiento informado en investigación se inscribe en la relación médico-paciente, que ha sufrido, y sigue sufriendo, importantes cambios: desde el planteamiento clásico, como relación de amistad, al planteamiento contemporáneo, como relación entre extraños, que es regulada por normas éticas y legales. El principal objetivo de estas últimas es conseguir, mediante requisitos formales, que dicha relación no perjudique al paciente. Bajo esta luz, se examina y compara el consentimiento informado en las principales normativas internacionales y en la ley española. Especialmente, (...) nos centramos en la hoja de información al paciente, la comprensión, la voluntariedad, la certificación y la comunicación de los resultados de la investigación. The complexity and emotional/psychological responses to the environmental challenges of the 21st century has led to the coining and development of new words and concepts that, for some people, better describe how they are personally grappling with anthropogenic ecosystem damage and climate breakdown. This paper identifies some of the more commonly used environmental neologisms within scholarly literature and evaluates their usefulness and contradictions for those influenced by the virtue ethics promoted by the ancient Stoics and the Catholic Church. We find (...) that environmental neologisms, when framed by these philosophical and/or theological ideas, offer an alternative and, ultimately, helpful means to contemplate the nature of what might be considered an environmental crisis and how best we might address, or at least, mitigate it, as conscientious spiritual human beings. The will to escape from the so called Metaphysics of Presence has become a topic in contemporary philosophy. However, this topic is often related to the primacy, in ancient thought, of the actual being, and the correlative evaluation of the potential as an imperfect way of existence. In this text we first analyze the traditional interpretation of the foundations of this primacy in Aristotle’s philosophy, that exhibits a theological form. According to this we explore, in the second part of the (...) article, how the efforts of modern thinkers to build an ontological discourse free from this primacy have produced, in some cases, a kind of Umkehrung resulting in a Metaphysics of Absence that preserves the theological form and results in a primacy of the potential, that is specifically consistent with the Imperium of the Virtual, very illustrative of nowadays conceptions of time, language, power and being. Finally, we essay to offer another interpretation of the primacy of the actual in Aristotle’s Ethics and Metaphysics, which could identify a political philosophy capable to avoid the infertile alternative Presence/Absence in ontology.
